DMX was taken into custody on Tuesday (Jan. 30) after testing positive for drugs, reports ABC News.

Manhattan Judge Jed Rakoff, who ordered he be jailed, said the rapper tested positive to opiates, cocaine and oxycodone, while also traveling to St. Louis without a drug counselor after he went to “extraordinary lengths” to allow him to continue performing to earn income to support his 15 children.

DMX was placed on probation after he pleaded guilty to tax evasion last November, after he was accused of not paying over $1.7 million in taxes over five years.

Rakoff also said DMX was a “genuine flight risk,” who repeatedly lied about complying with the terms of his bail.

The rapper’s lawyer Murray Richman claims that the rapper began using drugs again as an attempt to cope with his one-year old son’s illness — his son was hospitalized earlier this month with a 104 degree fever.
