Incarcerated rapper Remy Ma wants to be out of prison by the holidays, and has filed an appeal in hopes of making that happen.

According to TMZ, Remy Ma (real name: Remy Smith) and her lawyers have filed an appeal requesting that her eight-year prison sentence be dropped on grounds that the judge presiding over her case made countless mistakes during her trial.

"The trial court's order forbidding defense counsel from arguing during summation that Makeda Josephy (the victim) was shot during a struggle for the gun denied Ms. Smith a fair trial," the lawsuit reads. "Ms. Smith was unfairly prejudiced by the inclusion in the indictment of the counts regarding the violent gang assault at the Player's Club, as to which there was no evidence of her complicity, but which likely colored the jury's consideration of the remaining counts."

In court documents, the rapper's lawyers argue that several errors were made by the judge, which may have led to an inaccurate verdict. In closing arguments of the trial, earlier this year, Remy's attorney Ivan Fisher argued that Smith-Barnes' (the victim) testimony actually supported his client's explanation of the shooting as an accident.

However, the jury was instructed that if they believed the victim to be "truthful and accurate," under law, her words would have been enough to establish reasonable doubt.

Due to the circumstances, via the lawsuit, they are asking for a dismissal.

Remy Ma was convicted of first degree assault, criminal possession of a weapon and attempted coercion. She will not be eligible for parole until September 2014.

I don't support violent behavior,that's like if somebody caught somebody breakin in they house,just say somebody they knew,okay are you gonna stand and argue with that person about breakin in ur house? Hell no! The law says you have a right to protect ur property,its all in the way you do it! What they doing is going by the way she left the scene,that's gonna be there arguement. If she accidentally shot tha broad while they were fighting ova the gun,and called 911,and gave a statement on site,the charges what have been way different.

This case has tainted completely! I would ask that the d.a. Be replaced,I would request a new trial first,asking for a dismissal is huge,when attaching a lawsuit! That's when people start makin something outta nothing,coruption within the department is on the rise. They will coach witnesses,and have them lie,and make stuff up if they want you. I would fire the current attorney because where were these arguements doing the trial! I would hire a new team of attorneys! And I would demand for a jury of my peers,its the law. And make sure its racially balenced,and age approiate based on your remy peers! I would also request that the victim testimony be dismissed based on conflict of testimony. When your under oath,you can not keep changing up your story! Its clear that the so called victim is strictly about money,that's what she was about when she dug in remy purse! Back in the day,you get caught stealin that chop ur fingers off! Good luck Remy,keep ur head up mah!
