Colton City, Calif. rapper Big Bad 40, aka 40 Glocc, has been on trial since May, fighting a gang injuction filed against him in San Bernardino Country, Calif. that would censor his music, lyrics and anything else involved in his music career.
Through his publicist, the rapper (real name: Lawrence White) recently spoke about the trial, explaining some of the accusations against him and how authorities are using his lyrics against him despite his First Amendment rights, specifically the freedom of speech.
"They are using my songs against me. I thought the Constitution of the United States of America, which is where I live, grants me the first amendment which is freedom speech, I mean that's what I read," said 40.
Last month, the San Bernardino Count District Attorney's office said they have supporting evidence showing the rappers' top status in a gang, allegedly the Colton City Crips, and are trying to use his lyrics to prove it. With this alleged evidence, the D.A. hopes to quiet the rapper and ban him from using any type of gang references in his music, in interviews, or anywhere else in both his music and entertainment career.
However, 40 says that the D.A. has yet to provide evidence that he's been involved in any criminal activity.
In a press release, the rapper said the District Attorney had tried to pin drug distribution charges on him, but officers that testified under oath said that they no proof, nor has he been captured on video doing so. Although cameras place 40 at gang affiliated areas such as the Rancho Avenue and Mill Street, an area dubbed as "The Zoo," he says as of recent years, the area has proven safe.
Back in 1996, Big Bad 40 was suspected of being involved in a gun battle in San Bernardino, but was never charged. Police also reported that he has a tattoo on his chest of the letters "C.C.C.," which they said stands for "Colton City Crips." The rapper denies these claims though.
Furthermore, a recent newspaper article covering the case released bogus information on him, 40 claims and says proves the system is after him.
"My rights are being violated and somebody is lying on me. I don't have any tattoos on my chest and whoever is putting out this wrong information can come over here and take a picture," 40 explained. "They make things up when I boast and brag and tease them in my music, they find ways to punish me for not allowing them to dictate what I can and cannot do for my income and entertainment purposes."
Due to the controversy surrounding his name and music, 40 announced last month that he was permanently changing his rap moniker from 40 Glocc to Big Bad 40, pronounced Big Bad Four 0.
Despite his legal woes, 40 is continuing to work. He's currently enjoying growing buzz with his new single, "Damn" featuring Ray J. A music video for the track is coming soon.
