Ja Rule lost a bid to keep a loaded gun found in his vehicle from being used as evidence in his New York gun case this week.
According to ABCNews.com, a Manhattan judge said "no" to his legal team's argument that the gun was found during an unjustified police stop following a July 2007 concert, and will remain was evidence in his case.
Ja also attempted to have a marijuana charge tossed out, according to the New York Daily News, saying he had "a little bit of weed in my pocket" the night he was busted. That, too, will remain as evidence.
The rapper (real name: Jeffrey Atkins) has pleaded not guilty in the case. He could face up to four years in prison if convicted.
"Just left court, still no verdict!!! Gotta love the hood tho, ppl was like 'Yo weezy be here feb. 9th', like he's doin a show lmao...," he rapper tweeted (@RuleYork) early Wednesday morning.
Ja's attorney, Stacey Richman, told the paper that he plans to try to get DNA samples taken from the gun tossed because it's "low-copy DNA."
He was arrested in July 2007, after police pulled over his luxury Mercedes-Benz Maybach for speeding. After the stop, cops said they found a loaded .40-caliber Taurus handgun.
They also added that the gun's serial numbers had been ground off. Ja, along with two others, were charged with criminal possession of a firearm.
That same night, Lil Wayne's tour bus was pulled over by cops for a traffic violation. After smelling marijuana, they boarded the bus and reportedly found one member of his entourage trying to flush half a pound of pot down the toilet. A loaded .40-caliber Taurus handgun was also spotted in plain sight.
Weezy accepted a plea deal in December, where he is expected to received a one year setence in the case after he entered a guilty plea. He is scheduled to be sentenced in February.
