Chris Brown's attorney told reports outside a Los Angeles courtroom Wednesday (April 29) that he wants the assault case against his client dismissed, due to leaks in the investigation.
According to E! News, attorney Mark Geragos leaks -- such as the widely circulated photo of a battered Rihanna leaked by TMZ -- are grounds for a dismissal.
"Leaks can form the basis for a motion to dismiss the case in regard to outrageous governmental misconduct," Geragos said.
RadarOnline reports that Geragos will file a motion regarding the photo, as well as "several other incidents of leaks about the case." He will file a Pitchess motion, that typically allows defense counsel to examine the personnel file of police officers and could help in getting the assault case against brown dismissed.
When the photo first appeared on TMZ in February, the LAPD announced it would conduct an investigation into the leak, but no findings have been revealed as of press time.
Geragos appeared in court without Brown Wednesday, and requested additional discovery time, claiming evidence turned over by the LAPD still had not been presented to him.
The judge scheduled a new hearing for May 28.
Word is the D.A. and Brown's attorney has been working to strike a plea deal in the case.
Additionally, during Wednesday's court date, the judge ruled that police have to release Rihanna's jewelry, reportedly worth $1.4 million, that she'd been wearing the night of the incident. Police confiscated the items that evening and have held them as evidence.
